Terms and Conditions for Transport of Goods

1. Definitions and Scope

  • "Carrier" refers to The Green Room Kent LTD.

  • "Client" refers to the entity purchasing goods and the transportation services.

  • "Goods" refers to the items specified by the Client for transportation.

  • These terms apply to all road freight transport services provided, unless otherwise agreed in writing.

2. Carrier Obligations

  • Performance: The Carrier shall transport the Goods from Retail Unit to the designated delivery address (unless agreed otherwise).

  • Safety: The Carrier is responsible for using appropriate vehicles and ensuring the safety and integrity of the cargo during transport.

  • Documentation: The Carrier shall maintain necessary transport documentation and notify the Client of any delays, hindrances, or damage to the goods immediately.

  • Proper Packaging: The Carrier must ensure that the goods are packaged appropriately for transport to withstand normal handling and as per clients request.

  • Loading/Unloading: Unless otherwise agreed in writing, the Carrier is responsible for loading the goods. Unloading at the destination is the responsibility of the recipient.

  • Information Accuracy: The Client must provide accurate descriptions of the goods, including weight, volume, and special handling.

3. Delivery

  • Timeframes: Any delivery dates provided are estimates only. The Carrier is not responsible for losses caused by unexpected delays.

  • Inspection: The recipient must inspect the goods immediately upon arrival and note any damage on the transport document.

4. Liability and Insurance

  • Limitation of Liability: The Carrier’s liability for loss or damage is limited to the whole load.

  • Excluded Liability: The Carrier is not liable for indirect losses, such as loss of profit or market, resulting from delays or damage.

    Force Majeure: The Carrier is not liable for failures caused by events outside their control, such as natural disasters or extreme weather.

5. Payment Terms

  • Payment: Invoices are due for payment prior to delivery.

  • Suspension: The Carrier reserves the right to suspend services if full payment of goods and transport is not received on time.
